Terms and Conditions of the Atram Service

1. Introduction and Acceptance

Welcome to Atram's AI Agent service (the "Service"), offered through WhatsApp. By accessing or using the Service, you agree to these Terms and Conditions (the "Terms") and to our Personal Data Processing Policy. If you do not agree with these Terms, please refrain from using the Service.

2. Definitions

  • Service: Refers to the artificial intelligence agent provided by Atram, which offers personalized functions such as weather alerts, forecasts, and suggestions for preparedness against heavy rains and floods.
  • User: Any natural person who accesses or uses the Service.
  • Personal Data: Information that directly or indirectly identifies you, such as your name, location, or phone number.
  • Processing: Any operation carried out on Personal Data, including collection, storage, use, or deletion.
  • Data Controller: Bancamía S.A., which determines the purposes and means of the processing.
  • Data Processor: Atram Inc., which processes data on behalf of Bancamía.

3. Eligibility for Use

By using the Service, you represent that you are at least 18 years of age and that you have the legal capacity to accept these Terms.

4. Description of the Service and Data Collected

Description: The Service provides personalized information on climate-related risks, including alerts and recommendations to reduce losses caused by heavy rains.

Data Collected: The following data may be collected:

  • Business name and owner's name
  • Phone number (preferably linked to WhatsApp)
  • Location (city, municipality, or GPS coordinates)
  • Type of store and products sold
  • Average daily sales
  • History of impact from rains/floods
  • Customer behavior during rainy seasons

Collection Method: Through your interactions with the Service via WhatsApp.

5. Purpose and Legal Basis of Processing

Purpose: Personal Data is used exclusively to:

  • Personalize the services provided by the agent.
  • Send timely alerts on weather and flooding.
  • Provide preparedness recommendations for heavy rains.
  • Evaluate and improve the effectiveness of the Service.

Legal Basis: Processing is carried out based on the prior, express, and informed authorization of the Data Subject, in compliance with Law 1581 of 2012.

6. User Consent and Rights

Consent: By using the Service, you authorize Bancamía and Atram (as its Processor) to collect and process your data for the purposes described.

Withdrawal of Consent: You may withdraw your consent at any time by contacting us as indicated in Section 14.

Rights of the Data Subject:

  • To know, update, and rectify your data.
  • To request its deletion.
  • To revoke the authorization granted.
  • To file complaints before the Superintendence of Industry and Commerce.

7. Data Security

Atram implements reasonable technical and organizational measures to protect your data against unauthorized access, loss, alteration, or misuse. Although international security standards (including encryption) are applied, no system is 100% infallible.

8. Data Sharing and Third Parties

Third-Party Processors: Atram may rely on external providers to deliver the Service (e.g., for sending messages or generating alerts). All such providers will be bound by confidentiality and data protection agreements.

No Disclosure Without Authorization: Your data will not be shared with third parties other than those described, unless required by law.

9. Data Retention and Deletion

Retention Period: Your data will be retained only for as long as necessary to fulfill the purposes of the Service.

Deletion Request: You may request the deletion of your data at any time by contacting the email address provided below.

10. Service Limitations and Disclaimer

The recommendations provided are for informational purposes only. Atram does not guarantee that they will be suitable for your particular situation. You assume the risk of implementing any suggested action. Atram shall not be liable for damages or losses resulting from the use of such recommendations.

11. Modifications

Atram may amend these Terms at any time. Updates will be communicated via WhatsApp and shall take effect once published. Continued use of the Service constitutes acceptance of such changes.

12. Limitation of Liability

The Service is provided "as is" and "as available." Atram does not guarantee that it will be error-free or uninterrupted. Under no circumstances shall Atram be liable for indirect, incidental, or consequential damages arising from the use of the Service.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Republic of Colombia. Any disputes shall be resolved by the competent courts of Colombia.
